TERMS OF USE

These Terms of Use (“Terms”) govern your access to and use of the websites, games, applications, music, written works, digital content, and other products and services provided by EPPDX Creative LLC (“EPPDX,” “we,” “us,” or “our”).
By using an EPPDX product or service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the applicable product or service.
ABOUT EPPDX
EPPDX Creative LLC is an Oregon creative company that develops and publishes independent games, music, written works, and other creative projects.
Specific products may include additional rules, notices, or terms. If those additional terms conflict with these Terms, the product-specific terms control for that product.
ELIGIBILITY
You must be legally permitted to use our products and services in your location.
If you are under the age required to enter into a binding agreement where you live, a parent or legal guardian must review and accept these Terms for you.
ACCOUNTS
Some services may require an account or access code. You agree to provide accurate information, protect your credentials, and notify us promptly if you believe your account has been compromised.
You are responsible for activity performed through your account unless applicable law provides otherwise.
ACCEPTABLE USE
You may use our products and services only for lawful, personal, and non-commercial purposes unless we give you written permission otherwise.
You may not:
• Interfere with, disrupt, damage, or attempt to gain unauthorized access to our products, systems, accounts, or data.
• Use bots, scripts, exploits, cheats, scraping tools, or other automated methods that harm a service or create an unfair advantage.
• Harass other users, impersonate another person, or submit unlawful, abusive, fraudulent, or infringing content.
• Reverse engineer, copy, modify, distribute, sell, or commercially exploit our software or content except where applicable law expressly permits it.
• Use an EPPDX product in a way that violates these Terms, product-specific rules, or applicable law.
INTELLECTUAL PROPERTY
Unless otherwise stated, EPPDX and its licensors own the software, artwork, designs, logos, music, writing, graphics, trademarks, and other content included in our products and services.
These Terms grant you a limited, revocable, non-exclusive, and non-transferable right to use the applicable product for its intended purpose. No ownership rights are transferred to you.
Third-party names, trademarks, data, and content remain the property of their respective owners. Their appearance does not imply sponsorship, affiliation, or endorsement.
USER SUBMISSIONS AND FEEDBACK
If you send us feedback, ideas, bug reports, or other suggestions, you permit us to use them without restriction or compensation, provided that we handle personal information as described in our Privacy Policy.
Do not submit material you do not have the right to share.
THIRD-PARTY SERVICES
Our products may rely on or link to third-party services, including platform providers, hosting providers, data providers, advertising services, and payment processors.
Third-party services are governed by their own terms and privacy policies. EPPDX does not control and is not responsible for their availability, content, or practices.
GRIDZ
GRIDZ is a free sports prediction and squares-style game. It does not accept wagers, hold player funds, pay gambling winnings, or provide cash-out functionality.
GRIDZ points, standings, and game results have no cash value and are not redeemable for money from EPPDX.
League commissioners and participants are responsible for complying with applicable law and the rules of any private activity they organize outside GRIDZ. EPPDX does not organize, process, enforce, or guarantee outside payments, prizes, pools, or agreements between users.
Sports schedules, scores, and related information may come from public or third-party sources and may be delayed, corrected, incomplete, or unavailable. GRIDZ may update results when source data changes.
EPPDX is not affiliated with, endorsed by, or sponsored by the NFL, NBA, NCAA, WNBA, MLB, ESPN, Apple, Google, or any professional sports league unless expressly stated.
ADVERTISING
Some EPPDX products, including GRIDZ, may display advertising provided by third parties such as Google.
Advertising availability, selection, and presentation may depend on your location, device, consent choices, and the advertising provider’s policies. Our handling of information related to advertising is described in our Privacy Policy.
APP STORE TERMS
If you obtain an EPPDX application through Apple’s App Store, you acknowledge that these Terms are between you and EPPDX, not Apple.
Apple is not responsible for the application or its support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce applicable App Store provisions.
Your use of the application must also comply with Apple’s Standard Licensed Application End User License Agreement and applicable App Store rules:

UPDATES, AVAILABILITY, AND CHANGES
We may update, modify, suspend, or discontinue a product or feature, including to maintain security, comply with law, improve functionality, or address changes to third-party services.
We do not guarantee that any product, feature, score feed, or service will always be available, accurate, uninterrupted, or error-free.
TERMINATION
You may stop using our products at any time.
We may restrict or terminate access if you violate these Terms, misuse a service, create risk or legal exposure, or if a product is discontinued.
Provisions that by their nature should survive termination—including ownership, disclaimers, limitations of liability, and dispute provisions—will survive.
DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, EPPDX products and services are provided “as is” and “as available,” without warranties of any kind, express or implied.
We do not guarantee uninterrupted operation, perfect accuracy, compatibility with every device, or that defects will always be corrected.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, EPPDX Creative LLC and its members, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
This includes lost profits, lost data, loss of goodwill, service interruptions, and losses arising from third-party services or user-organized activities.
Where liability cannot legally be excluded, EPPDX’s total liability for claims arising from a product or service will not exceed the greater of:
• The amount you paid EPPDX for that product during the twelve months before the claim; or
• One hundred U.S. dollars.
This limitation does not apply where prohibited by law.
INDEMNIFICATION
To the extent permitted by law, you agree to defend, indemnify, and hold harmless EPPDX Creative LLC and its members, employees, contractors, and service providers from claims, losses, liabilities, and reasonable expenses arising from:
• Your unlawful use of our products.
• Your violation of these Terms.
• Your infringement of another person’s rights.
GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
Before filing a legal claim, you and EPPDX agree to make a reasonable, good-faith effort to resolve the issue by contacting the other party.
Legal proceedings that are not subject to another mandatory jurisdiction may be brought in a court of competent jurisdiction in Oregon.
GENERAL TERMS
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. The unenforceable provision will be enforced to the greatest extent permitted by law or modified as necessary to reflect its intended purpose.
EPPDX’s failure to enforce a provision does not waive the right to enforce it later.
You may not transfer your rights or obligations under these Terms without our written consent.
EPPDX may assign these Terms as part of a merger, reorganization, sale, or transfer of a product or business.
CHANGES TO THESE TERMS
We may update these Terms from time to time. We will post the revised Terms and update the effective date.
Your continued use of a product after an update takes effect means you accept the revised Terms, to the extent permitted by law.
